The Huxley Group Proprietary Limited (trading as the Huxley School of Makeup) and its affiliates, directors, officers, trainers, employees, agents and third-party contractors, will be referred to as ‘The Huxley School of Makeup’ herein. 2. ___________________________ (name) will be referred to as, ‘the student’ and ‘you’ herein. 3. This Agreement constitutes the entire agreement between you and the Huxley Group Proprietary Limited, (trading as “The Huxley School of Makeup”) pertaining to the subject matter of this agreement. 4. This agreement supersedes all prior written communication, oral transmissions and any other agreements between the parties relating to the addressed subject matter of the agreement. 5. Subject to any conditions and warranties mandatorily implied by law and to any conditions and warranties expressly contained herein, all conditions, warranties and representations on the part of the Huxley School of Makeup, whether express or implied, are hereby expressly excluded. 6. The Student and the Huxley School of Makeup agree that the terms of this Contract may be altered unilaterally by the Huxley School of Makeup giving 14 days’ written notice to the student. Clerical errors are subject to correction without notification. 7. The Huxley School of Makeup may amend or modify this agreement at any time in writing. 8. In the event of any dispute arising between the parties hereto, the parties will, without prejudice to any right or entitlement, use their best endeavours to resolve their dispute using negotiation, mediation, independent expert appraisal or any other alternative dispute resolution technique. If a resolution cannot be achieved in the matter either of parties may seek judgement before a Court of Law. 9. The Agreement shall be governed by and interpreted in accordance with the laws of the State of Queensland and both parties submit to the non-exclusive jurisdictions of the Courts of Queensland. 10. If any provision of this Agreement shall be held invalid, illegal or unenforceable the remaining provisions hereof shall remain in full force and effect. 11. This Agreement remains in full effect perpetually, or until it is revoked in writing by the Huxley School of Makeup. 12. By signing this Agreement, you agree that you are of a sound mind and impart full legal capacity to enter into and perform your obligations under this Agreement. 13. You agree to pay the full course fees as outlined on your student enrolment form. The course fees are also referred to on our website (www.huxleyschoolofmakeup.com) 14. You may be eligible to apply for a VET FEE-HELP Loan through TAFE Queensland to cover part of your course fees. In such circumstance, you agree to be bound by the terms and conditions of TAFE Queensland. You understand that a VET FEEHELP Loan, if eligible, may not cover the entire course fees and in the circumstance thereof, you will be required to pay the remaining course 15. Where you do not apply for, or are ineligible for, a VET-Student Loan, you will be required to pay the course fees in their entirety. 16. The student agrees to pay the course fee in its entirety. 17. You agree to be bound by, and adhere to, our student handbook. You understand that a breach of any rules outlined in the student handbook may result in suspension, or termination of, your course at the Huxley School of Makeup. In the event of a breach of any rules of the student handbook you agree that disciplinary action may be taken, as deemed necessary by the course convenor. 18. An upfront, non-refundable, six hundred (600) dollar deposit is required to secure your position within your chosen course at the Huxley School of Makeup. 19. An administration fee of two hundred and fifty (250) dollars is charged on all courses. 20. All tuition fees paid are non-refundable. 21. International students are required to pay fifty percent (50%) of the course fee before commencement of the program and pay the remaining course fee by completion of the program. 22. The Huxley School of Makeup will take professional photos across numerous photoshoots to support students in developing their professional portfolios. These images will be distributed after graduation of the course. 23. If a student fails to complete two (2) or more modules, the student must request to re-sit the modules. The course convenor imparts absolute discretion in deciding if a student may re-sit a module. If a student wishes to re-sit a module, there will be a two hundred and fifty (250) dollar fee per module they wish to re-sit. 24. If time permits, there are specific catch-up lessons allocated at the end of course, in which a student can choose to re-sit a module or use for personal portfolio development. 25. If a student wishes to withdraw an enrolment, the student will be required to pay the full course fee. The student/financier agrees this term is reasonable, considering the significant cost and inconvenience caused by re-enrolling terminated placements. 26. The Huxley School of Makeup will not in any capacity provide refunds if a student wishes to cancel their enrolment. 27. By signing this document, you agree that The Huxley School of Makeup, its affiliates, directors, officers, trainers, employees, agents or third-party contractors are indemnified from liability for any losses, damages, compensation or other remedies, howsoever arising (including but not limited to negligence). The Huxley School of Makeup in no way attempts to abrogate statutory requirements of liability. Where required by statute, total liability for any losses, damages, compensation or other remedies, howsoever arising (including but not limited to negligence) shall not exceed one percent (1%) of the course fee. 28. I give the Huxley School of Makeup the unrestricted, irrevocable and worldwide permission to use the photograph(s)/images and/or videos therefrom and any other reproductions or adaptations, therefrom, either complete or in part alone, or in conjunction with any wording and/ or imagery/videography for all uses including publicity, marketing, commercial purposes and/or merchandising and/or editorial purposes in any country. 29. The Huxley School of Makeup may assign or sell the rights to the photographs/ images/videos to a third-party without restriction. I understand that I do not have any interest in the copyright to the photographs/images/videos, nor shall I receive any payment in such case. 30. Classes may be cancelled, postponed or rescheduled at any point by the director or course convenor of the Huxley School of Makeup. Although every effort will be made to reschedule these classes, in no circumstances will any compensation be awarded if a class is not rescheduled. 31. Instances of bullying or violence to staff, trainers or students will be handled immediately by the director and course convenor of the Huxley School of Makeup. If a student is found to have bullied or been violent to fellow students or faculty, it will result in immediate cancellation of enrolment in the course. In such circumstances, the student/financier will be required to pay all unpaid tuition fees. 32. Classes and workshops will typically be held at the Huxley School of Makeup campus in Burleigh Heads. Occasionally, work experience and classes may be held at other locations. In the event of a class being held at another location, the Huxley School of Makeup will not provide any allowances or reimbursement for associated costs with travelling to these locations. 33. By signing this document, you agree to pay the explicated course fee within the prescribed time period. In the event of a failure to pay the course fee, the Huxley School of Makeup reserves the right to undertake legal proceedings and debt collections. 34. The student will fall into default where the required payment is not made for thirty (30) days. 35. In the event of a default, the Huxley School of Makeup will impose a two hundred- dollar default fee. Interest will be charged at 15% per annum where a student falls into default. 36. The student will be liable for all legal, court and debt collection fees that have been incurred in the process of reclaiming unpaid course fees. 37. The student acknowledges and agrees that the Huxley School of Makeup is authorised to contact a credit reporting agency throughout the term of the Agreement to obtain a report about the creditworthiness of the Customer. 38. The student authorises the Huxley School of Makeup to engage in the exchange of information with a credit reporting agency or with other such parties as are necessary to give effect to the contract and to the ongoing relationship between the parties hereto. 39. The Huxley School of Makeup reserves the right to report a student’s delinquent account to a credit reporting agency should payment remain outstanding for more than 30 days. 40. Enrolments cannot be deferred under any circumstances. 41. If a student is unable to commence or continue a course they have enrolled in but wishes to continue program at a later date, the student must complete a re-enrolment form and pay the re-enrolment fee. The course convenor imparts full discretion in deciding if a student can obtain a credit for fees already paid. The timing between courses and circumstances for discontinuation of the original enrolment will be considered. 42. Students must give twenty-four hours notice if they are unable to attend a class. 43. The Huxley School of Makeup is bound by the Privacy Act 1988, in which all personal information is kept confidential except where required by statute or government departments or for the purposes of planning, administration and communication. 44. I/We acknowledge, accept, consent and warrant that I/ we have obtained the consent of any person whose personal information appears herein (if any) to the use of information in accordance with the provisions of these terms. 45. The Huxley School of Makeup may use personal information contained in the application to obtain credit reports containing consumer credit information and/or commercial credit information about the Applicant from credit reporting agencies. 46. The Huxley School of Makeup may use such personal information and any information disclosed by credit reporting agencies, in accordance with the Privacy Act 1988 (Cth), in assessing or enforcing the credit application including with respect to delinquent accounts. Personal information may be disclosed to or between the Huxley School of Makeup’s related companies, contractors, other credit providers, finance providers, service providers and the Huxley School of Makeup’s risk insurers and debt collectors. The Huxley School of Makeup hereby gives notice in accordance with Section 18E(8) (c) of the Privacy Act that any personal information which is permitted to be kept on a credit information file might be disclosed to credit reporting agencies now or in the future. Upon request, any person may gain access to his/her personal information. 47. Complaints, applications and appeals must be received and recorded in writing and be accompanied by sufficient and valid evidence to substantiate the complaint, application or appeal. Complaints are taken very seriously by the Huxley School of Makeup and every attempt will be made to find a resolution. 48. Students must be sixteen (16) years of age to enrol in a course at the Huxley School of Makeup, however it is a requirement that a minor has parental consent to enrol in the course. If a student has not reached the age of majority, the course enrolment and contract must be entered into by a parent or guardian, who has reached the age of majority, on behalf of the minor 49. If a student has enquiries they should refer to the course handbook or approach the course convenor. 50. It is a requirement that students attend all compulsory classes or workshops. 51. All assessments must be completed to a passing standard set by the course convenor of the Huxley School of Makeup. In the event of failure of an assessment the student will be required to re-attempt the assessment piece. If the student subsequently fails the assessment a second time, they will be required to re-sit the module, in which they will incur a fee of two hundred and fifty (250) dollars.
